The removal of Justice Gertrude Araba Torkornoo from her role as Chief Justice of Ghana has sparked a legal battle at the ECOWAS Court, highlighting ongoing debates about human rights and judicial independence within the region.
Legal expert Austin Kwabena Brako-Powers stated in a television discussion that the ECOWAS Court in Abuja is fully empowered to handle the case.
According to him, the Court’s mandate enables it to proceed on human rights matters once allegations are raised, making it unnecessary for complainants to prove their claims at the initial stage.
Justice Torkornoo claims her dismissal violated her rights, including dignity, fair hearing, and just working conditions. Ghana’s Deputy Attorney-General has contested the Court’s jurisdiction, but critics argue this stance is legally weak, citing past rulings favoring human rights over technical objections.
