MENSAH THOMPSON&ANOR V ATTORNEY GENERAL TO HEARD BY SUPREME COURT TODAY

In the case of Mensah Thompson v. Attorney General on the matter of Asset declaration notice is here by issued to the media that the case would be heard today at the Supreme Court by a panel of 5 justices.

The court will sit at exactly 9:30 AM to hear the application of the petitioners who are seeking among other things for the Supreme Court to make a declaration that the provisions of the public officeholders declaration of asset and disqualification Act, Act 555 contravenes the express Provisions of Article 286 of the 1992 Constitution of the Republic of Ghana and therefore null and void.

That the six month window given for Asset declaration by public office holders to the declare their asset and liabilities flies in the face of Article 286 which provides that such declarations must be done before assuming office, and not

Six (6)months after assuming office.

The petitioners are also seeking the Supreme Court to Declare that public office holders, who declared their asset in accordance With the provisions of Act 555 were in breach of Article 286 and therefore must be struck out and made to re-declare their assets in accordance with the tenets of Article 286 of the 1992 Constitution.
